SMQ agrees to receive, group and reship packages to Saint Martin or Saint Barthelemy for its clients according to selected service.
3-1. Reception of parcel
SMQ is committed to receive packages for clients at the condition that the address entered by the customer is accurate and the Identity Number are stated so that the parcel can be assigned to the right customer. The customer will be notified by mail for each receipt of a parcel belonging to him in the 48 hours following the delivery in the premises of its provider.
The list of approved packages will be available in the customer area of the buyer.
SMQ cannot be held responsible for the failure in which he would receive and therefore deliver a package in the event of error on the part of the client.
In addition, SMQ will charge € 10 (ten euros) of additional fees for any approved package with an incomplete address; in particular, in the absence of the customer number in the delivery address.
Finally, SMQ cannot be held responsible for the state in which packages are received even if they have obvious external damage or missing items.
3-2. Workover and parcel storage
Using the services of Select 'n Ship, the buyer authorizes SMQ to open all packages in his name and repackage them if necessary. SMQ is committed in return to open the packages only in the following cases:
-Bill product only available inside the approved package,
-doubt about the content of the approved package,
-customer number not listed on the approved package.
If an overcharge or a discount should apply following the Workover operations, the buyer would be notified at the time of the final changes to the order. The refund or additional billing should be set at the payment.
Packages are stored free of charge a maximum of twenty days from their date of repackaging. Care expenses will be charged from the 21st day. As the 61st working day package will be deemed to be abandoned. A package say abandoned will be withdrawn by the company SMQ in its normal distribution and blocked until payment by the customer of all fees already charged as well as a flat-rate charge of € 150. In the absence of payment, package will be systematically unlocked one calendar year after the date of receipt to be auctioned or destroyed, as stipulated in the legislation.
3-3. shipment of the packages
To minimize the risk of blocking in customs, a package may be shipped once the SMQ will be able to attach an invoice of the product located in the said parcel. Therefore, it is the responsibility of the purchaser to provide as soon as possible his invoice. The company SMQ, however, does not guarantee the good customs clearance of parcels that it ships: it remains at the discretion of the purchaser to ensure that its products comply with the standards and restrictions in force.
Packages will be shipped only after delivery and shipping regulation. In the case of delivery by DHL, FEDEX or USPS, parcel will be shipped to the address returned by the user during the creation of his account provided that it is located in the community of Saint Martin or Saint Barthélemy.
3-4. Invoice and payment
The appliable rates of the order are shown on the Select'n Ship site; whether it is the price of the service provided by SMQ or the amount of participation in the shipping costs applied (varying in function, dimensions and weight package, its destination and dispatch). The company SMQ furthermore reserves the right to charge supplements of non-compliance for any reception of parcel anonymous, voluminous, unstable or overheight following the rates indicated by the Select site'n Ship.
Payment is done on receipt of the invoice, exclusively on the website via the payment secure of our banking partner (CAISSE D'EPARGNE) module.
In accordance with the laws in force in the French Republic, late payment penalties and a lump sum of € 40 is due full the day following the settlement date mentioned on the invoice. The annual rate of delay penalties amounts to 12%.
3-5. liability and warranties
In the case of a delivery by DHL, FEDEX or USPS, SMQ commitment ends with the shipment of the packages. The company is therefore not concerned by any customs duties and taxes which are fully charged and at the discretion of the buyer. Similarly, the buyer shall manage only his possible absence at the time of delivery (the parcel will be left caution to the local postoffice for 10 days).
Therefore, SMQ is not responsible should a parcel be returned or if storage costs should be charged, if the client does not withdraw his package to position or our partners in freight services.
In the event of loss of the package under the responsibility of the SMQ, if it was in possession of the entirety of the invoices required at the time of the expedition, SMQ undertakes to reimburse :
- if the package value is under 200 euros : € 23 per kilo with a limit of 200 euros.
- if the package value is above 200 euros : € 23 per kilo
